الملخص:

إن المساهمة البحثية هذه ومن خلال العنوان المقترح، حاولنا من خلالها  تسليط الضوء على الدور الذي يلعبه الجهاز المراقب للتراب أو سلطات المراقبة الادارية في تفعيل القرار العمومي الترابي وكذا الآثار التي تنتجها على مستوى فعاليته كأهم الأطراف المتدخلة هي الأخرى في حياة القرار الترابي. حيث أن الدولة غالبا ما تنظر إلى إلزامية استمرار تدخلها في القرار الترابي وتأزيم استقلاليته، من زاوية سلبية ناتج عن أوضاع تاريخية ميزت العلاقة بينها وبين محيطها خاصة أواخر القرن التاسع عشر، لهذا ظلت متشبثة بتدخلها من خلال استمرار وتكريس هذا من قبل المشرع في كل التجارب التشريعية الحديثة، حيث أنها ترى في أي توسيع لنسبة استقلالية الوحدات الترابية تهديدا لها، كون الأمر قد أو غالبا ما سيولد طمعا انفصاليا يوما ما، وتبقى متذرعة فقط بشعار أزمة النخب المحلية.

وانطلاقا مما سبق ارتأينا إلى إبراز بعض ممكنات الملاءمة بالنسبة لهذه السلطة؛ سواء من الجانب التشريعي الذي يتجلى في كل من تماشي القوانين التنظيمية وروح المقتضى الدستوري، وكذا إمكانية تبني نظام التشريعات الاستثنائية جهويا. في حين ركزنا على بعض المعطيات الواجب توافرها في العنصر أو الجانب البشري التي تكمن أساسا في تحفيز و تكوين الموارد البشرية عن طريق التحفيز الهادف و التكوين المستمر إلى جانب تأهيل الكفاء ات الإدارية واعتماد الانتشار و الحركية وهو ما من شأنه أن يساهم في صناعة القرار العمومي الترابي بطرق أنسب و أنجع وبالتالي تجويد و فعالية هذا القرار.

Abstract:

Proceeding from the above, We decided to highlight some Convenience Enablers for this authority Whether from the legislative aspect that is evident in both the consistency of organizational laws and the spirit of the constitutional requirement, as well as the possibility of adopting a system of exceptional legislation regionally. While we focused on some of the data that must be available in the human element or aspect, which mainly lies in the stimulation and formation of human resources through targeted motivation and continuous training, in addition to qualifying administrative competencies and adopting the spread and mobility, which would contribute to the making of the public and territorial decision. In ways that are more appropriate and more effective and thus improve the effectiveness of this decision.
