فلسفة الإعلان العالمي لحقوق الإنسان

Philosophy of the Universal Declaration of Human Rights

ملخص :

حرصنا في هاته المساهمة المعرفية على أن نثير بعض الإشكالات والمفارقات الفلسفية التي تقف عائقا أمام فهم وتطبيق قواعد الإعلان العالمي لحقوق الإنسان في التعاملات الدولية، وذلك من خلال رصد الفكر الفلسفي الكلاسيكي الذي كان يقارب المسألة الحقوقية من خلال منطق ثنائي القيمة؛ أي منطق يرتكز على سيطرة الفكر اللاهوتي في تدبير المسائل الحقوقية للمجتمعات. ومن ثم حاورناه (الفكر الفلسفي الكلاسيكي) بأهم مقومات التصور الفلسفي الحقوقي الحديث الذي بُني على أنقاضه، حيث ارتكز على بعض الدعائم الفلسفية التي ترمي إلى تعميم هاته الحقوق بين جل الشعوب والدول، باعتبارها الطريق الأنسب في إرساء مشروع السلام الدائم بين كل مكونات الشعوب والدول.

كما حاولنا أن نثري المقاربة الفلسفية الحديثة الداعية للكونية في الحقوق، بالانفتاح على الطروحات الفلسفية لأنصار التوجه المدافع عن الخصوصية في الحقوق، والتي ارتكزت على ضرورة مراعاة مقتضيات الخصوصية في تنزيل هاته الحقوق؛ سواء كانت هذه الخصوصية فردية أو جماعية.

بالإضافة إلى كوننا قد توقفنا عند أهمية القيمة الفلسفية للتعددية كخيار استراتيجي يوازِي بين التوجهات الفلسفية المتعددة والمتنوعة، إذ عُدت في الفكر المعاصر بمثابة النفق الذي يمكن الولوج عبره  في الحفاظ على التوازنات الدولية. وبذلك نكون قد استعرضنا بعض أهم العوائق الفلسفية الموجودة في جسد الإعلان العالمي لحقوق الانسان.

Abstract

In this cognitive contribution, we were keen to raise some of the philosophical problematics and paradoxes that hinder the understanding and application of the rules of the Universal Declaration of  Human Rights in international dealings, by observing the classic philosophical thought that approached the human rights issue through dual-value  logic. We mean by this, the logic based on the control of theological thought in managing human rights issues of societies.

Then we have  interviewed it (the classical philosophical thought) with the most important components of the modern human rights philosophical concept that was built on its ruins, as it was based on some of the philosophical pillars that aim to generalize these rights among most peoples and states, as it is the most appropriate way to establish a permanent peace project between all components of peoples and states.

We have also sought  to enrich the modern philosophical approach that calls for universalism in rights, by recalling the philosophical propositions of the partisans of privacy in rights, which are based on the necessity of observing the requirements of  privacy  while implementing  these rights ; whether this privacy is individual or collective.

In besides of  evoking the importance of the philosophical value of pluralism as a strategic choice that equates the various and diverse philosophical trends, as it is considered in contemporary thought like a form of  underpass  that can be followed in maintaining international balances.

Thus, we have presented some of the most important philosophical obstacles prevailing in the body of the Universal Declaration of  Human Rights.
